By accessing the Hamza Hotel website (https://hamzahotel.com), placing an order via WhatsApp, or visiting our restaurant, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Description of Services

Hamza Hotel ("we," "us," or "our") provides dine-in restaurant services at our Shivajinagar location, food delivery, and takeaway services. We operate primarily as a heritage restaurant specializing in Biryani and Mughlai cuisine. Orders and table reservations can be facilitated through our website, phone, or WhatsApp Business API.

3. Eligibility

You must be at least 18 years old to place an order for delivery or make a binding reservation. By using our services, you represent and warrant that you meet this age requirement.

4. Ordering Process and Confirmation

Orders are primarily placed via our designated WhatsApp number (+91 800 800 4202). An order is considered confirmed only when you receive a confirmation message from us. We reserve the right to refuse service or cancel orders at our discretion.

5. Pricing and Payment Terms

All prices listed on our menu are in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST) unless stated otherwise. We accept:

6. Delivery Policy and Limitations

We offer delivery services within specific serviceable areas in Bengaluru. Delivery times provided are estimates and are not guaranteed, especially during peak hours, traffic conditions, or adverse weather. The customer is responsible for providing an accurate delivery address and contact number. Risk of loss/damage to the food transfers to the customer upon handover to our delivery personnel or third-party delivery partner.

Our food may contain or come into contact with common allergens such as dairy, nuts, gluten, and eggs. While we take precautions, we cannot guarantee completely allergen-free meals. Customers with severe allergies should exercise caution and inform us prior to ordering.

All content on our website and marketing materials, including but not limited to the "Hamza Hotel" trade name, logos, menu designs, text, and images, are the intellectual property of Hamza Hotel Boarding and Lodging and are protected by copyright and trademark laws. Unauthorized use is strictly prohibited.

Users agree not to misuse our WhatsApp ordering system, make false reservations, or engage in abusive behavior towards our staff or delivery personnel. Violation of this term may result in a permanent ban from our services.

11. Limitation of Liability

To the fullest extent permitted by law, Hamza Hotel shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use our services. Our total liability for any claim arising from these terms or our services shall not exceed the amount paid by you for the specific order giving rise to the claim.

You agree to indemnify and hold harmless Hamza Hotel, its partners, and employees from any claims, damages, or expenses arising from your violation of these Terms of Service or your violation of any rights of a third party.

13. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872 and the Information Technology Act, 2000. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

14. Dispute Resolution

In the event of any dispute, the parties shall first attempt to resolve the matter amicably through good-faith negotiations. If unresolved, the dispute may be referred to arbitration in Bengaluru in accordance with the Arbitration and Conciliation Act, 1996.

15. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting on this page. Your continued use of our services constitutes acceptance of the modified terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
